Practitioner Subscription Terms and Conditions
Last updated: 6.10.26
1. Introduction and Parties
1.1 These Practitioner Subscription Terms (“the Terms”) govern the relationship between Trusted Psychologists Ltd (company number 17316686), whose registered office is at 20 Wenlock Road, London, England, N1 7GU (“we”, “us”, “our”), the operator of the online directory at trustedpsychologists.co.uk (“the Site”), and you, the psychological practitioner registering to list a profile on the Site (“you”, “Practitioner”, “Subscriber”).
1.2 By completing the registration process and ticking the acceptance box, you confirm that you have read, understood, and agree to be bound by these Terms in full. These Terms constitute a legally binding contract between us.
1.3 These Terms apply exclusively to practitioners subscribing to list on the Site. Separate Terms and Conditions govern the use of the Site by clients and visitors.
1.4 If you do not agree to these Terms, you must not register or maintain a listing on the Site.
2. About the Service
2.1 Trusted Psychologists Ltd is an online directory service. We provide a platform that allows HCPC-registered psychological practitioners to list a profile and for members of the public to search for and submit enquiries to practitioners directly.
2.2 We are a directory service only. We do not provide psychological services, medical advice, or clinical support, and we do not act as agent, employer, or partner of any practitioner listed on the Site.
2.3 Any services you provide to clients who contact you through the Site are provided by you directly and entirely independently of Trusted Psychologists Ltd. We are not a party to any therapeutic or contractual relationship between you and your clients.
2.4 We do not take a commission on any fees you charge to clients. The subscription fee you pay to us is solely for access to and listing on the directory.
3. Eligibility
3.1 To subscribe and maintain a listing on the Site, you must at all times:
- hold current, valid registration with the Health and Care Professions Council (HCPC) in a relevant psychological discipline;
- hold valid professional indemnity insurance in an amount appropriate to the nature and volume of your practice;
- be legally entitled to work in the United Kingdom;
- be aged 18 or over; and
- have the legal capacity to enter into a binding agreement.
3.2 By registering, you warrant that you meet all eligibility criteria set out in clause 3.1 and that all information provided to us is accurate, current, and not misleading.
3.3 We reserve the right to verify your eligibility at any time during the subscription term and to request evidence of HCPC registration or professional indemnity insurance on reasonable notice. Failure to provide such evidence within 14 days of a request shall entitle us to suspend your listing pending resolution.
3.4 We check your HCPC registration against the public HCPC Register before your profile is approved and every three months while your profile is listed. You consent to these checks and to our recording the date and outcome of each one.
4. Subscription and Fees
4.1 Access to the Site as a practitioner is subject to payment of a monthly subscription fee. The subscription period is one calendar month. The applicable fee and any available subscription tiers will be set out clearly during the registration process and on the Site.
4.2 Fees are payable in advance for the relevant subscription period. All fees are stated inclusive of VAT where applicable. As at the date of these Terms, Trusted Psychologists Ltd is not VAT registered.
4.3 Your subscription will automatically renew on a monthly basis unless you give written notice of cancellation in accordance with clause 10 below.
4.4 We reserve the right to amend our subscription fees at any time, subject to providing you with not less than 30 days’ written notice prior to the start of the next billing period. If you do not accept the revised fee, you may terminate these Terms without penalty by giving written notice before the revised fee takes effect, in accordance with clause 10.2. Continued use of the Site after the revised fee takes effect will constitute your acceptance of the new fee.
4.5 All fees are non-refundable save as expressly set out in these Terms or as required by applicable law.
4.6 If payment fails or is not received by the due date, we reserve the right to suspend your listing until payment is received in full. We may charge interest on overdue amounts at the rate of 8% per annum above the Bank of England base rate, calculated daily, pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.
4A. Trial Membership
This clause applies only where we have offered you a free trial period. Where it conflicts with any other clause of these Terms, this clause 4A takes precedence for the duration of your trial.
4A.1 Free trial membership is offered at our discretion to HCPC-registered Practitioners. Where a trial is offered to you, this will be confirmed during registration.
4A.2 Your trial begins on the date your profile is approved and runs for three (3) months from that date (“the Trial Period”). No subscription fee is payable during the Trial Period.
4A.3 As part of the registration process, you will be asked to provide payment card details. By providing these details, you authorise Trusted Psychologists Ltd to store your card details with Stripe, our payment processor, and to charge that card in accordance with this clause 4A once your Trial Period ends. We do not hold or have access to your full card details ourselves; these are collected and stored by Stripe under its own security standards. No charge is taken from your card at registration, while your profile is being reviewed, or at any time during the Trial Period.
4A.4 Unless you cancel in accordance with clause 4A.5 before your Trial Period ends, your membership will automatically convert to a paid monthly subscription at the fee confirmed to you during registration, with effect from the date your Trial Period ends, and your card will be charged accordingly. From that date, clauses 4.1 to 4.6 above apply to your subscription in full.
4A.5 You may cancel at any time before your Trial Period ends at no charge, by written notice to info@trustedpsychologists.co.uk. Cancellation under this clause takes effect immediately on our receipt of your notice and, notwithstanding clause 10.2, no notice period applies. Cancellation instructions will also be included in your trial confirmation email.
4A.6 If the payment described in clause 4A.4 does not go through when your Trial Period ends, we will flag your account for manual review rather than automatically suspending or removing your listing, and will contact you to resolve the issue. If the matter is not resolved within a reasonable period following our contact, clause 4.6 shall then apply.
4A.7 If your profile is rejected rather than approved, any card details you have provided will be deleted in full and no charge will be made. If a decision on your profile has not been made within 14 days of you providing card details, those details will automatically be removed from our records pending a decision, and re-requested if and when your profile is subsequently approved.
5. Profile Content
5.1 By submitting a profile, you confirm and warrant that:
- all information provided is accurate, current, complete, and not misleading;
- you hold the HCPC registration number submitted and that it is valid at the time of submission;
- you hold professional indemnity insurance as required under clause 3.1;
- any areas of practice, therapeutic modalities, qualifications, and fee information listed are accurate and will be kept up to date;
- you have the right to use all images submitted, including your profile photograph, and that their use does not infringe the rights of any third party;
- your profile content does not infringe the intellectual property rights of any third party; and
- your profile content does not contain anything that is false, defamatory, offensive, or unlawful.
5.2 You are responsible for keeping your profile content current and accurate at all times during the subscription term. You must notify us promptly (and in any event within 5 working days) of any material change to your profile information, including but not limited to:
- any change to your HCPC registration status;
- any change to your professional indemnity insurance;
- any change to your stated areas of practice, fee rates, or availability;
- any fitness to practise proceedings commenced against you; or
- any criminal charge or conviction that may be relevant to your suitability to practise.
6. Intellectual Property
6.1 The design, layout, graphics, and content of the Site (excluding your submitted profile content) are the intellectual property of Trusted Psychologists Ltd and may not be reproduced, distributed, or used without our prior written consent.
6.2 By submitting a profile, you grant Trusted Psychologists Ltd a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your profile content on the Site and in any promotional materials relating to the Site for the purpose of operating the directory service. This licence shall terminate upon the removal of your profile in accordance with these Terms.
6.3 You retain all intellectual property rights in the content you submit. Nothing in these Terms transfers ownership of your profile content to us.
7. Introductory Calls and Client Relationships
7.1 You may choose to offer clients a free introductory call prior to any engagement. Any such offer is made by you independently and at your sole discretion. Trusted Psychologists Ltd does not guarantee, endorse, or take any responsibility for introductory calls or any commitments made during them.
7.2 Any engagement with a client who contacts you through the Site is a direct relationship between you and that client. You are solely responsible for:
- your professional conduct in all client interactions;
- compliance with your professional obligations under HCPC Standards of Conduct, Performance and Ethics;
- compliance with all applicable legal and regulatory requirements governing your practice;
- the terms on which you provide services to clients, including your own terms of engagement, fee arrangements, and cancellation policies; and maintaining appropriate records and confidentiality in respect of all client interactions.
7.3 You must maintain your own terms of engagement and, where required, a privacy notice for clients engaging your services directly.
7.4 You remain solely responsible for all safeguarding obligations arising from your practice. This includes holding an enhanced DBS check where required by your professional body or the nature of your work, maintaining clinical supervision arrangements appropriate to your role, and exercising professional judgement, including statutory referrals or reports without delay, where a client or prospective client appears to be at risk. Trusted Psychologists Ltd does not monitor, supervise or have visibility of any interaction between you and a member of the public following an enquiry made through the Site, and is not responsible for identifying or responding to safeguarding concerns arising from your practice. You must notify us at info@trustedpsychologists.co.uk where a safeguarding concern relates specifically to your use of the Site itself, without prejudice to any statutory reporting obligations you may have.
7.5 Trusted Psychologists Ltd is not designed or intended to provide crisis intervention, emergency support or monitoring of members of the public who use the Site. The Site is not a substitute for emergency services or urgent mental health support. You must not represent Trusted Psychologists Ltd as providing urgent care or guaranteed immediate support, and you remain solely responsible for risk management and escalation within your own professional scope for anyone who contacts you through the Site.
8. Approved Use and No-Circumvention
8.1 You may use the Site only for the purpose of listing your profile and receiving client enquiries through the directory. You must not use the Site to:
- submit false, misleading, or fraudulent information;
- impersonate any person or misrepresent your qualifications, registration, or experience;
- transmit any unsolicited or unauthorised advertising or promotional material;
- attempt to gain unauthorised access to any part of the Site or its underlying systems;
- scrape, harvest, or collect data from the Site without our prior written consent;
- transmit any harmful, offensive, or unlawful content; or
- interfere with the proper operation of the Site.
8.2 You must not use client contact details or information obtained through the Site to solicit, divert, or migrate clients to a competing directory service, another platform, or your own direct channel for the primary purpose of avoiding the subscription fee payable to Trusted Psychologists Ltd.
8.3 Nothing in clause 8.2 prevents you from maintaining your own independent website, direct contact details, or other legitimate marketing activities, provided these do not constitute a deliberate and systematic exploitation of leads generated through the Site.
9. Approval, Suspension and Removal of Profiles
9.1 All profiles are subject to our approval prior to going live on the Site. We reserve the right to approve, reject, or request amendments to any profile at our sole discretion.
9.2 We reserve the right to suspend or remove your profile at any time, including but not limited to circumstances where:
- information provided is found to be inaccurate, misleading, or materially incomplete;
- your HCPC registration lapses, is suspended or removed, is subject to conditions of practice or another restriction, or cannot be confirmed on the HCPC Register;
- you fail to maintain adequate professional indemnity insurance;
- a complaint is received from a client that raises concerns about your professional conduct;
- we receive notice of fitness to practise proceedings against you;
- payment of the subscription fee is overdue;
- your profile breaches these Terms or any applicable law; or
- we reasonably consider suspension or removal necessary to protect the safety or interests of clients or the public.
9.3 Where we suspend or remove a profile for reasons other than those set out in clause 9.2, we will give you not less than 14 days’ written notice.
9.4 Where we suspend or remove a profile pursuant to clause 9.2, we may do so immediately and without notice. In such circumstances, no refund of fees paid in advance will be due.
9.5 Where a registration check under clause 3.4 cannot confirm your registration, we will hide your profile and contact you. If you provide evidence that your registration is current and unrestricted, we will restore your profile promptly.
10. Termination
10.1 Either party may terminate these Terms at any time.
10.2 If you wish to terminate these Terms and remove your profile, you must provide not less than 30 days’ written notice to info@trustedpsychologists.co.uk. Your listing will remain active during the notice period and you will remain liable for any fees falling due during that period. Where you are within your Trial Period, clause 4A.5 applies instead of this clause 10.2.
10.3 We may terminate these Terms immediately and without notice in the event of:
- a material breach of these Terms by you;
- a lapse, suspension, or invalidation of your HCPC registration;
- your insolvency or the commencement of formal insolvency proceedings;
- fitness to practise proceedings that, in our reasonable opinion, pose a risk to client safety; or
- circumstances where we consider immediate termination necessary to protect the safety or interests of clients or the public.
10.4 On termination of these Terms for any reason:
- your profile will be removed from the Site within a reasonable time (and in any event within 5 working days of the effective date of termination);
- any personal data held by us will be handled in accordance with our Privacy Policy and applicable data protection law, and we will keep your profile information for 6 years after your profile is removed from the Site;
- any fees paid in advance are non-refundable unless termination is initiated by us for reasons other than your breach, in which case a pro-rata refund of any unexpired subscription period will be payable; and
- termination shall not affect any rights or obligations of either party that have accrued prior to the date of termination.
11. Liability
11.1 To the fullest extent permitted by law, Trusted Psychologists Ltd shall not be liable to you for:
- any loss of revenue, profit, business, or opportunity arising from use of or reliance on the Site;
- any failure or delay in the availability of the Site due to circumstances beyond our reasonable control;
- any loss arising from inaccuracies in the Site or its functionality;
- any indirect, consequential, or special loss of any kind; or
- any actions, claims, or liability arising from your conduct in respect of any client relationship.
11.2 Our aggregate liability to you under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim.
11.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
12. Force Majeure
12.1 We shall not be in breach of these Terms or liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to acts of God, cyberattacks, third-party platform outages, telecommunications failures, government action, or pandemic.
12.2 We will notify you as soon as reasonably practicable of any such event and take reasonable steps to mitigate its impact. If the force majeure event continues for more than 30 days, either party may terminate these Terms on written notice without liability.
13. Data Protection
13.1 Trusted Psychologists Ltd is registered with the Information Commissioner’s Office (ICO) as a data controller. We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
13.2 We will process your personal data (including your name, contact details, HCPC registration number, and profile content) for the purposes of operating the directory service and administering your subscription. Full details are set out in our Privacy Policy, available on the Site.
13.3 Where client enquiries are transmitted to you through the Site, you will receive personal data relating to that client. You acknowledge that, in respect of any such data, you act as an independent data controller and are solely responsible for ensuring your handling of that data complies with all applicable data protection legislation, including the UK GDPR and the Data Protection Act 2018.
13.4 You must maintain your own compliant privacy notice for clients engaging your services directly.
13.5 Where we use automated tools, artificial intelligence, or machine learning systems in connection with the operation of the Site (including for profile moderation, search functionality, or content processing), we will disclose this in our Privacy Policy.
14. Confidentiality
14.1 Each party agrees to keep confidential all non-public information disclosed by the other party in connection with these Terms and not to disclose such information to any third party without the prior written consent of the disclosing party, except as required by law or regulation.
14.2 This obligation of confidentiality shall not apply to information that:
- is or becomes publicly available other than through a breach of these Terms;
- was already known to the receiving party at the time of disclosure; or
- is independently developed by the receiving party without reference to the confidential information.
14.3 For the avoidance of doubt, client enquiry information received by you through the Site is confidential client data and must be treated accordingly in accordance with your professional obligations.
15. Complaints
15.1 We take all complaints seriously and are committed to resolving them promptly and fairly. If you have a complaint about the Site or your subscription, please contact us at info@trustedpsychologists.co.uk (please mark your subject line “Complaint”).
15.2 We will acknowledge your complaint within 5 working days and aim to provide a full response within 28 days.
15.3 If your complaint relates to a client’s professional conduct complaint against you, you should refer to your obligations under the HCPC Standards of Conduct, Performance and Ethics and engage with any regulatory process independently of Trusted Psychologists Ltd.
16. General
16.1 These Terms, together with our Privacy Policy, constitute the entire agreement between the parties relating to your subscription and supersedes all prior representations, negotiations, or agreements relating to the same subject matter.
16.2 If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unenforceable, or illegal, that provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.
16.3 No failure or delay by either party in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver on one occasion shall not constitute a waiver on any subsequent occasion.
16.4 We reserve the right to update or amend these Terms from time to time. We will provide not less than 30 days’ written notice of any material changes. Continued use of the Site after the effective date of any changes constitutes acceptance. If you do not accept the changes, you may terminate these Terms in accordance with clause 10.2.
16.5 You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms to any successor entity that acquires ownership or control of the Site.
16.6 All notices under these Terms must be in writing and sent to info@trustedpsychologists.co.uk (for notices to us) or to the email address provided at registration (for notices to you). Notices sent by email shall be deemed received on the next working day following transmission.
16.7 These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.
17. Governing Law and Jurisdiction
17.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
17.2 Any disputes arising under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
